Seeking South Carolina debt relief can stop debt collectors

Consumers possibly frustrated by aggressive debt collection practices are beginning to fight back by using lawsuits. Recent data shows that, even though consumer debt and bankruptcies are actually declining, the number of lawsuits against debtors is climbing. Many South Carolina residents who are frustrated with harassing phone calls from debt collectors seek debt relief through various means, including bankruptcy protection. Doing so can actually stop those types of phone calls and offer consumers the ability to gain a clean financial slate.

Some believe the lawsuits signal that consumers are beginning to push back against debt collectors' aggressive collection practices. A staff attorney for a nonprofit group asserts that the number of lawsuits is climbing because the improper and unethical behavior of debt collectors is rising, and more inaccurate information is being reported about consumers. He also believes that consumers are becoming more knowledgeable and are learning how to use the system to fight back against such practices.

The majority of lawsuits filed allege that companies are violating both the Fair Debt Collection Practices Act (FDCPA) and the Fair Credit Reporting Act (FCRA). Consumer advocates state that, although consumers are protected against unfair practices by federal law, there are still some debt collectors that use those practices against consumers who may owe money. In addition, credit reporting agencies could victimize consumers due to disorganized reporting procedures, potentially damaging someone's credit report because of mistaken items listed.

Seeking debt relief is a way for consumers to stop harassing debt collection calls. Overwhelming debt can be stressful for both the debtor and their family. Options exist in South Carolina to help consumers overcome their debt and gain financial freedom once again.
