South Carolina debt relief: Company fights collector over calls

Sometimes for South Carolina residents, seeking debt relief through bankruptcy can be the most financially responsible move possible, and can help consumers emerge from overwhelming financial problems. Debt relief can offer consumers the opportunity for a fresh financial start, and can also stop harassing debt collection calls at home or at work. One person who allegedly owed a debt to NCO Financial Systems is probably feeling very fortunate to work for Whataburger right now. The restaurant chain has stepped in and filed a lawsuit against the collection company, alleging harassment.

Instead of contacting the employee about the debt, NCO chose to repeatedly call the company's headquarters. Instead of putting pressure on the company to force the employee to pay, the tactic backfired in a major way. Whataburger sued the collection company and is seeking punitive and actual damages. The fast food giant claims that NCO's actions to attempt to get the debt paid were 'unreasonable and reckless.'

This is an extremely unusual step for an employer to take, but could send a clear message to collection companies everywhere. Whataburger claims that NCO has continued to repeatedly contact their headquarters in spite of a cease-and-desist letter. Over 50 calls have been made to Whataburger since June, causing distraction to the employees and keeping company phone lines tied up. The collection company has not returned phone calls seeking comment on the pending litigation.

Seeking debt relief through a personal bankruptcy filing in South Carolina can halt this type of unscrupulous behavior, and can help individuals begin to build a solid financial foundation. Stress over financial problems can be exacerbated when consumers are hounded by collections companies. Perhaps this lawsuit will send a message to collection agencies that harassing behavior will not be tolerated.
