South Carolina credit card debt: Fight back against collectors

Gaining control of credit card debt can be difficult for South Carolina residents. With the dirty tactics some collection agencies use, certain residents may lean more toward paying them just to stop the harassing phone calls and letters. However, one man recently fought a collection agency over alleged credit card debt and won.

The collection agency had filed a lawsuit against the man and claimed he owed them over $1,500 for a MasterCard debt. The company had apparently purchased the debt from HSBC. The complaint against him included copies of the man's credit card application and a billing statement from two years ago. However, the judge in the case ordered the company to prove that they had the authority to actually collect the man's debt.

The judge wanted the company to provide copies of the man's original credit card agreement, the terms and conditions and documents proving the man's debt was either transferred or sold to them. The company then dropped its lawsuit against the man. Apparently it is a common practice with collection agencies to pursue debts against people even though they may have questionable claims, faulty documents or even insufficient records proving the debt.

Some South Carolina residents may pay debts just to get collectors off of their backs. However, sometimes those debts may not actually be legitimate. Fighting back is a good way to assert one's legal rights and show debt collectors that their practices won't be tolerated. Credit card debt can be overwhelming for consumers but people in such a situation have options available to them beyond only fighting a debt. Bankruptcy could help keep collectors off of a consumer's back while they attempt to get their financial lives in order.
