World's first-dubbed supermodel files for Chapter 7 relief

If a debt is unsecured and there's no fraud by the consumer, it can be wiped out in a personal bankruptcy. That was something that celebrity-model Janice Dickinson, who dubs herself the world's first supermodel, must have looked into prior to filing her recent Chapter 7 bankruptcy. If you're filing in South Carolina or elsewhere, debts incurred for years of plastic surgery and anti-aging programs will normally be erased by bankruptcy. These are considered medical bills, which are usually always discharged in a Chapter 7.

However, a bill doesn't have to be medical to be discharged - any unsecured loans or debt incurred with businesses or individuals are wiped out in a Chapter 7, absent unusual circumstances. Dickinson, who is 58, was most recently known for appearing as a judge on the reality program, 'America's Next Top Model'. She listed nearly $1 million in debt in the bankruptcy.

Much of that concerns Botox and plastic surgery incurred through years of dodging another collector, known as Mother Nature. She also has major problems with someone known as Uncle Sam, to whom she owes back taxes. Her bills, ranging up to 10-years-old, to the IRS, the State of California and other agencies total about $500,000. Barring any unusual twists, recent tax bills three-years-old or newer are excluded from a bankruptcy discharge, but older ones may be wiped out.

She listed back rent due of $5,900 on her West Los Angeles residence, and she was also being evicted. When a bankruptcy is filed, the court issues an order called the 'automatic stay', which orders all creditors to cease and desist from further collection activities. This includes stopping all evictions, foreclosures or repossessions and similar actions.

She'll get at least temporary protection from the eviction, although tougher Chapter 7 laws in South Carolina and throughout the nation now give a landlord expedited consideration in such matters. All in all, she may be able to wipe out a good majority of her tax debt and all of her remaining bills for medical and plastic surgery. She apparently has no valuable assets that exceed the statutory exemptions, which means that she'll keep all of her standard furnishings and belongings, while discharging hundreds of thousands of dollars in burdensome debt.
